Terms and Conditions

HomeTerms and Conditions

I. General Terms and Conditions of Use.

These General Terms and Conditions govern access to, browsing and use of this Website. We recommend that you carefully read this Legal Notice before browsing the Website.

By accessing or browsing the Website and/or using the services provided therein, you acquire the status of User and accept, without reservation of any kind, each and every one of these General Terms and Conditions of Use, as well as any Specific Conditions that may govern the provision of services available on the Website. This is without prejudice to the User’s obligation to observe and comply with the terms and conditions established by websites linked from this portal, for which this portal assumes no responsibility.

This portal may modify the General Terms and Conditions of Use, as well as any Specific Conditions that may be established, at any time and without prior notice.

In all cases, the User agrees to make appropriate use of the content and services offered by this portal and, by way of example but not limitation, undertakes to:

(i) Refrain from engaging in unlawful or illegal activities or activities contrary to good faith and public order;

(ii) Refrain from introducing, storing or distributing, on or through the Website, any information or material that is explicitly or implicitly defamatory, insulting, obscene, threatening, xenophobic, supportive of terrorism, pornographic, or that incites violence or discrimination on the grounds of race, sex, ideology or religion, or that otherwise violates morality, public order, fundamental rights or public freedoms, particularly the honour, privacy or image of third parties and, in general, human rights.

(iii) Refrain from using false identities or impersonating others when using the Website or any of the services provided, including the use of third-party passwords or access credentials, or through any other means.

Consequently, the User may not attempt to access or use other users’ passwords or access credentials, nor modify or manipulate their messages.

(iv) Refrain from introducing, storing or distributing through the Website any computer program, data, virus, code, hardware or telecommunications equipment, or any other electronic or physical instrument or device capable of causing damage to the Website, any of its services, or any equipment, systems or networks belonging to this portal or, in general, to any third party, or that may otherwise cause any type of disruption or prevent their normal operation.

(v) Refrain from destroying, altering, using for personal purposes, disabling or damaging the data, information, programs or electronic documents belonging to this portal or any third party.

(vi) Refrain from introducing, storing or distributing through the Website any content that infringes third-party intellectual or industrial property rights or trade secrets, or, in general, any content that the User is not legally entitled to make available to third parties.

(vii) Refrain from using the services offered on the Website to promote external companies or services, other websites, or to conduct advertising or commercial campaigns, or to act for the benefit of legal entities.

In the event of a breach of the above conditions, this portal reserves the right and shall be entitled to immediately block, suspend or terminate access to and use of the Website without prior notice and, where applicable, to remove content alleged or declared to be illegal, whether at its sole discretion or at the request of an affected third party or competent authority.

II. Liability.

This portal shall not be held liable for any loss or damage arising from, including but not limited to:

(i) Inferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections affecting the operation of this electronic system or the computer devices and equipment of Users, caused by circumstances beyond the control of this portal, which prevent or delay the provision of services or navigation through the System.

(ii) Delays or interruptions in use caused by deficiencies or overloads of the Internet or other electronic systems.

(iii) Damage caused by third parties through unlawful interference beyond the control of, and not attributable to, this portal.

(iv) The inability to provide services or allow access due to circumstances not attributable to this portal, including those caused by the User, third parties or events of force majeure.

(v) Discrepancies in the information, documentation and/or other Website content that may exist between the electronic and printed versions.

III. Personal Data Protection.

The User authorises the processing of personal data voluntarily provided. Likewise, the User shall be responsible for the accuracy of the information supplied, and this portal reserves the right to exclude from registered services any person who has provided false information, without prejudice to any other legal actions that may apply.

The data provided by the data subject shall be used solely and exclusively for the purposes established in the relevant administrative procedure or action.

Under no circumstances shall such data be processed or disclosed to third parties without the unequivocal consent of the data subject, except in the cases provided for in Articles 6.2 and 11.2 of Law 15/1999 of 13 December on the Protection of Personal Data (LOPD).

In accordance with Organic Law 15/1999, the person providing the data may exercise their rights of access, rectification, cancellation and objection at any time by submitting a written request accompanied by a photocopy of their Spanish National Identity Document (DNI), Foreigner Identity Number document (NIE), passport or equivalent identification document.

We also inform you that when visiting this Website, your browser may store technical information on your computer. The use of cookies or IP addresses does not provide any personal information or information about your computer. They are intended solely to help save time when you return to our Website, select the most appropriate style sheet, and ensure that websites are displayed correctly, including the language and character encoding settings of your browser (for example, to ensure that accented characters are displayed properly). They may also help us improve the design of our websites and compile statistics, specifically to determine the number of unique visitors to our Website.

Users who do not wish to store cookies on their computers may configure their browsers accordingly. Most modern browsers allow cookies to be managed in three different ways:

  • Cookies are never accepted.
  • The browser asks the user whether each cookie should be accepted.
  • Cookies are always accepted.

The browser may also offer more detailed options for specifying which cookies should or should not be accepted. In particular, Users can generally choose from the following options: reject cookies from specific domains; reject third-party cookies; accept cookies as non-persistent (deleted when the browser is closed); or allow the server to create cookies for a different domain. Additionally, browsers may allow users to view and delete individual cookies.

In any case, this portal does not use any such information (cookies or IP addresses) that may be recorded for any other purposes or uses.

IV. Use of Digital Certificates and Electronic Signatures.

Digital certification is the only means of technically and legally guaranteeing a person’s identity on the Internet. It is an essential requirement for public institutions to provide secure services over the Internet.

User certificates, such as those issued by the Spanish National Mint and Stamp Factory (RCM-FNMT), among others, contain the following information:

  • User identification details: Tax Identification Number (NIF), surname and first name, or registered company name.
  • Certificate number.
  • Certificate issuance date.
  • Certificate expiry date.
  • Public key, and
  • Digital signature of the issuing entity.

This set of data, together with the private key stored in the browser or web server of the certificate holder, ensures that, when used for digital signature generation and encryption, connections between web browsers and servers maintain the authenticity, confidentiality, integrity and non-repudiation of exchanged messages.

Furthermore, the data contained in the digital certificate is processed solely for the purposes of verifying the validity and ownership of the digital certificate. Such data shall not be processed for any other purposes, nor transferred or disclosed to third parties, except in the cases provided for by law.

V. Intellectual and Industrial Property.

The source code, graphic designs, images, photographs, sounds, animations, software, texts, domain names, trademarks, as well as the information and content provided throughout the Website, are protected under Spanish law for the benefit of this portal.

The use, reproduction, distribution, public communication, transformation or any other similar or equivalent activity involving such materials is strictly prohibited without the express authorisation of those responsible for this portal.
